Draft, under legal review
Terms of service
Last updated October 9, 2026
These terms are the agreement between you and XII Studios LLC (“Nanny”, “we”, “us”) for the Nanny app, this website and related services. Please read them, especially section 3 (we are not an employer or agency) and section 16 (how disputes are resolved).
1. Accepting these terms
You accept these terms and our privacy policy when you create an account or use Nanny. If we change these terms in a way that matters, we will ask you to accept the new version in the app.
2. Who can use Nanny
You must be at least 18 and able to form a binding contract. Caregivers must be legally allowed to work in the United States. Centers must hold any license their state requires. One person per account, and you are responsible for activity on it.
3. Nanny is a marketplace, not an employer or agency
Nanny provides a place to find each other and tools to book, pay, communicate and run care. We do not employ caregivers, refer or place them, set their rates, assign shifts or supervise care. Families and centers decide whom to hire and are responsible for their decisions, including interviews, references and any household employer duties. Caregivers decide which work to accept and how to do it.
4. Verification has limits
Badges show which checks a person completed, which company ran them and when. ID checks are run by Stripe Identity. Background checks and driving records are run by Checkr, a consumer reporting agency, which the caregiver orders with their consent. CPR certificates and references are reviewed as described on our safety page. Checks cover only what they cover, on the date they ran. We do not guarantee anyone's conduct, and no check replaces your own judgment.
5. Bookings, payments and fees
- Families pay for care through Stripe. Caregivers are paid through Stripe Connect and must accept Stripe's terms. Nanny does not hold funds in a wallet or stored balance.
- Families pay a booking fee shown before they confirm: 6% with a $1.99 minimum, or 3% with a $0.99 minimum on Nanny Plus. Fees for regular care are capped each month per family and caregiver at $59, or $39 on Plus. Backup care adds a $15 urgency fee.
- Caregivers pay nothing to join, get connected or get paid, and keep 100% of their pay plus tips. Instant payouts cost 1.5% with a 50 cent minimum. Standard payouts are free.
- Centers pay for the Center plan as shown when they subscribe.
6. Cancellations and no-shows
- Cancel free 24 hours or more before the start.
- Under 24 hours, the caregiver receives 50% of the booked pay, capped at 4 hours.
- Under 2 hours, or if the family is not there, the caregiver receives 100% of the booked pay, capped at 4 hours.
- Caregiver cancellations under 24 hours and no-shows add a reliability strike. Three strikes in 90 days pause the profile.
7. Household employment and taxes
A caregiver who works regularly for a family is often that family's household employee. In 2026, a family that pays one household employee $3,000 or more in a year usually owes payroll taxes. Nanny can tell you when you approach that threshold and connect you to a payroll partner, but we do not give tax or legal advice and we do not act as anyone's employer of record.
8. Subscriptions
Nanny Plus ($14.99 a month or $119.99 a year) and Caregiver Pro ($7.99 a month) are auto-renewing subscriptions billed through your Apple ID, or through a web checkout where offered. They renew at the then-current price until you cancel. You can cancel in one tap in the app or in your Apple ID settings, at least 24 hours before renewal to avoid the next charge. Refunds for App Store purchases are handled by Apple.
9. Daycare centers
Centers are responsible for their licensing, ratios, staff screening, pickup procedures and the accuracy of the records they keep in Nanny. Nanny provides the tools; the center runs the center.
10. Your content and reviews
You own what you post. You give us a license to host, display and process it to run Nanny. Reviews can be written only after a completed, paid booking, are published double blind, and can receive one reply. We remove reviews only when they break our community guidelines, never because they are negative, and nobody can pay us to remove one. Nothing in these terms stops you from giving an honest review, including under the Consumer Review Fairness Act.
11. Community rules and moderation
You agree to follow our community guidelines. We may remove content, pause accounts while we review a report, and suspend or close accounts that break these terms or put anyone at risk. Urgent reports about a child's safety pause an account pending review.
12. Cameras and recording
If you use cameras in your home, you are responsible for following the law where you live, including telling caregivers, recording video only in common areas, not recording audio where all-party consent is required, and never recording in bathrooms or a live-in caregiver's private space.
13. Things you may not do
- Use Nanny for anything illegal, or to harm, harass, deceive or exploit anyone, especially a child.
- Ask for or make payments for Nanny bookings outside the app, or run scams.
- Discriminate unlawfully in hiring or in how you treat others.
- Post about people who are not users, or post photos of other people's children or of caregivers.
- Scrape, copy or reverse engineer the service, or get around its limits or safety features.
14. Third-party services
Stripe, Checkr, Apple, camera makers and other providers are governed by their own terms. We are not responsible for their services.
15. Disclaimers and limits of liability
Nanny is provided as is. To the fullest extent the law allows, we disclaim implied warranties, and we are not liable for the acts or omissions of users, including caregivers, families and centers. Our total liability for any claim is limited to the greater of the fees you paid us in the 12 months before the claim or $100. Some places do not allow these limits, so they may not apply to you.
16. Disputes
Draft for legal review. [Placeholder: informal resolution period, individual binding arbitration, class action waiver, small claims carve-out and a 30-day opt-out window will be set out here after review by counsel. Until this section is final, disputes are governed by section 17.]
17. Governing law
These terms are governed by the laws of the State of California and applicable federal law, without regard to conflict of laws rules.
18. Ending your account
You can delete your account in the app at any time. Bookings already completed, payments owed and these terms as they apply to past use survive.
